Italian Senate approves draft law banning apology of or instigation to criminal activities on the internet

On 5 February, the Italian Senate approved the draft law on public safety, which includes measures in Article 60 that will allow the Ministry of the Interior to ask Internet access providers (ISPs) to withdraw or filter out any offensive material on websites hosted by them within 24 hours, if this material “incites to or provides the apology of criminal activities”.

The text of this Article has been proposed by Senator Gianpiero d’Alia, following police investigations into some Facebook groups' activities supporting two major Mafia bosses, such as Salvatore Riina and Bernardo Provenzano, both convicted of innumerable murders.

The group supporting Provenzano suggested making him a saint, whereas the group supporting Riina includes typical fan comments such as “you are my idol”.

Non-compliance with the withdrawal or filtering out request can be punished by an administrative sanction comprised between 50,000 and 250,000 €.

The text has been transferred to the Chamber of Deputies for final approval.
