Italian Court holds ISP managers responsible for content uploaded by third party

The Tribunal of Milan condemned three Google managers for failure to comply with the Italian privacy code.

The case was brought by a public prosecutor in Milan, against four managers of Google Italy, for not having blocked the online posting on Google Video of a video showing a minor with a Down syndrome being insulted and beaten by four students in a Turin school.

The video was posted in 2006 and as soon as the Italian police notified Google, was taken offline. Google helped the police trace the person responsible for uploading as well as the four fellow-students who were all sentenced to 10 months community work.

The Court indicted the Google managers for reasons of criminal defamation and failure to comply with the Italian privacy code. The charge of defamation was lifted, but the Court ruled that “company law cannot prevail upon the “dignity of the individual” and the protection of individual rights."

Google announced they will appeal the judgement.
